Preamble and Introduction

By using any of BLIP's Internet services or any related services (collectively or individually, the "Services") provided by BLIP or their partners and/or associates (collectively, "BLIP"), you agree to the following terms and conditions of service (the "Terms of Service"): These Terms of Service constitute the understanding between BLIP ("BLIP" or "our") and the customer ("you" or "your") subscribing to all or any of the Services. Radios and optional WiFi Router Equipment is provided for your use by BLIP, in which case the Equipment shall be herein referred to as the "Provider Equipment". By activating and using the Services, you acknowledge that you have read, understand and agree to these Terms of Service as set out below. In addition to the terms contained in these Terms of Service, your utilization of Internet Services is subject to the terms and conditions of the BLIP Acceptable Use Policy, available at www.gotblip.net. BLIP recommends that you print a copy of these Terms of Service and the Acceptable Use Policy.

BLIP may make changes to the Services and offers from time to time. If you do not wish to be bound by these Terms of Service, or any modifications which may be made by BLIP from time to time, do not use the Services and immediately contact BLIP. YOUR CONTINUED USE OF THE SERVICES AFTER THE EFFECTIVE DATE OF ANY CHANGES MADE, CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS OF SERVICE AS MODIFIED BY SUCH CHANGES. The customer can obtain more information about the Services and these Terms of Service by contacting BLIP's customer services at the telephone number(s) shown on the front of your billing invoice or on-line at www.gotblip.net.

Use of Services

BLIP's Acceptable use Policy (AUP) i. The Services may only be used in accordance with the BLIP's Acceptable Use Policy, available at www.gotblip.net ii. BLIP is not required to provide the Services when the Service Location is located outside of BLIP's service area, BLIP would have to incur unusual expenses to bring the Services to the Service Location, which you do not agree to pay, or when you have failed to make payment of the amounts due for the Services and/or the Provider Equipment.

Content

BLIP does not warrant the condition or content you are able to access on the Internet through the use of BLIP Internet Services. You acknowledge that there may be programming content or other content that you may find offensive and you agree that your viewing and/or use of such content is at your own risk. Some programming and/or content may not be suitable for minors and you agree to supervise all minors whom you permit to view content from Internet through your account with BLIP.

Equipment, Installation, Maintenance and Return Responsibilities

BLIP shall be permitted to install the Provider Equipment in the Service Location. The Provider Equipment is provided solely for your use of the Services and will at all times remain the property of BLIP. You will not sell, lease, transfer or assign the Provider Equipment. You may use the Provider Equipment only at the Service Location address you have indicated to BLIP at the time you subscribe to the Services. You will not re-arrange, disconnect, remove, tamper, repair or otherwise interfere with the Provider Equipment and any such action may constitute theft of services and/or assets.

i. Charges for Provider Equipment provided by BLIP will be included as part of the monthly Services fee. BLIP may require you to pay a Provider Equipment deposit prior to providing you with the Provider Equipment. You agree to keep all of the Provider Equipment free and clear of any lien or encumbrance of any kind whatsoever.

ii. You are responsible for the safekeeping of the Provider Equipment. If, while in your care, the Provider Equipment is damaged, lost or stolen you agree to pay BLIP the full cost to repair and/or replace the Provider Equipment, and authorize BLIP to charge your credit card account or your preauthorized payment authorization for associated costs.

iii. On the termination of the Services you agree to grant BLIP permission to access the Service Location to remove the Provider Equipment, and agree that BLIP is not required, to alter, repair, replace or re-install wiring, siding, shingles, trim or other facilities. iv. In the event that the Provider Equipment is not recoverable, you hereby authorize BLIP to charge your credit card account or your preauthorized payment authorization, in payment for the replacement cost of the Provider Equipment. To arrange return of Provider Equipment contact BLIP's customer service by phone at 877-711-2547.

v. All End User Equipment and Devices required for access and use of the Services such as telephones, home security, medical, automation, fax machines, computer equipment or any other equipment and/or associated devices (collectively, "Your Equipment") shall be and remain your responsibility. You agree that BLIP is not responsible for any installation, damage, maintenance, support or loss to Your Equipment arising from your use of the Services.

Service Interruption / BLIP's Right of Entry

i. Except when defined in an Individual Service Level Agreement, BLIP and/or its agents may interrupt and/or inspect the Provider Equipment and/or the Services at any time for any duration of time, without notice or liability to you in order to install, inspect, repair, replace or perform necessary maintenance on the Provider Equipment, its facilities and/or network, or for other technical reasons as may be required.

ii. You agree to provide BLIP access to the Provider Equipment (including reasonable access to the location the Services are provided ("Service Location") as may be reasonably necessary under the circumstances. BLIP is only required to provide you reasonable notice if BLIP needs access inside the Service Location. If you are not the owner of the Service Location, it is your responsibility to obtain and maintain access rights for provisions of this paragraph.

iii. You understand that the Services do not function in the event of a power failure and regardless of where the power failure arises. In addition, a power failure or disruption may require BLIP to reset or reconfigure the Provider Equipment, its facilities and/or network to reactivate the Services.

IMPORTANT:

BLIP does not warrant uninterrupted use of the Services.

Payment Terms and Conditions

i. BLIP will bill you each month for the services, by sending electronic invoice to your account "Official Email", provided at the time of setup. You may change the account Official Email by sending notice of the request to Billing@gotblip.net.

ii. You agree to pay BLIP the total charges for use of the Services, including, without limitation: fees applicable to Installation and/or Service Visits; Provider Equipment return charges; processing fees, late fees, and other costs incurred by BLIP, if your account is past due; any applicable regulatory taxes or surcharges for use of the Services. All such fees may be changed from time to time.

iii. You agree to pay all amounts by the date indicated on your invoice, by using any of the payment methods accepted by BLIP. Payments made after the statement date on your invoice will be reflected on your next invoice. Unpaid balances 30 days beyond the Invoice date, are subject to a $5 late fee and possible Service suspension.

iv. If your account becomes suspended for non-payment, you agree to pay a re-activation fee of $20.00.

v. You agree to a $25.00 Insufficient Funds Fee if your credit card is denied or if your check is returned due to non-sufficient funds.

vi. Payment of the full amount due will be required before the Services may be restored on suspended accounts. Overdue accounts are subject to termination of the Services by BLIP.

vii. You are responsible to ensure that the billing information you provide BLIP is accurate, and agree to promptly notify BLIP of any changes in your billing information.

viii. You are responsible for all costs, including legal fees, collection agency fees, or Court costs incurred by BLIP to collect any amounts owing under these Terms of Service.

ix. Any promotional discounts applied to your account for your enrollment in Automatic Payments, will be due in full in event that you discontinue automatic payments.

x. BLIP reserves the right to examine your credit records at any time, whether before or after providing you the Services.

Termination and Suspension

i. You may terminate the Services for any reason at any time by providing BLIP no less than 30 days advance notice of your desire to terminate. Applicable Service charges continue to apply until the end of the notice period, or such time as the Services are no longer accessible.

ii. You agree that if the Services are terminated for any reason you will: a. Pay BLIP in full any amounts due and outstanding for your use of the Services and return the Provider Equipment to BLIP; and b. Permit BLIP to access the Service Location at a mutually agreed upon time to remove the Provider Equipment.

iii. BLIP may restrict, block, suspend or terminate all or any part of the Services immediately where you:

     a. fail to make timely payment on your account for the Services for more than 60 days.

     b. become bankrupt or otherwise insolvent;

     c. fail to provide BLIP with reasonable entry and access to perform necessary maintenance on the Provider Equipment

     d. are in breach of any term or condition of these Terms of Service or of BLIP's Acceptable Use Policy applicable to the Services that you subscribe to

     e. use harassing conduct toward BLIP, it's employees or other customer's; harassing conduct may include but is not limited to slanderous statements/claims, offensive jokes, slurs, name-calling, physical assaults or threats, ridicule, insults, offensive pictures, profane language, and more.

iv. BLIP will attempt to notify you using the information shown on your account stating the reason and date scheduled for the suspension or termination.

BLIP's Liability

BLIP shall not be liable for:

i. any interruption or unavailability of the Services.

ii. your conduct, acts or omissions;

iii. any event beyond the reasonable control of BLIP including acts of God, inclement weather (including lightning), power failures, labor disputes, riots or civil disputes, war or armed conflict, any law, governmental order, decision or regulation, or order of any court of competent jurisdiction;

iv. any defacement of, or damage to, the Service Location resulting from the attachment of any instruments, apparatus or associated wiring and/or the Provider Equipment furnished by BLIP, or removal thereof., when such defacement or damage is not wholly caused by BLIP's negligence; and

v. any damages you incur as a result of the operation or failure of Your Equipment used with the Services, including without limitation if any of Your Equipment now or later become incompatible with the Provider Equipment and/or the Services. THESE TERMS OF SERVICE SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF ILLINOIS AND YOU HEREBY CONSENT TO THE EXCLUSIVE JURISDICTION OF THE COURTS IN JACKSON COUNTY, ILLINOIS. THESE TERMS OF SERVICE CONSTITUTE THE ENTIRE UNDERSTANDING BETWEEN THE PARTIES WITH RESPECT TO THE SUBJECT MATTER OF THESE TERMS OF SERVICE AND SUPERCEDES AND REPLACES ANY AND ALL PRIOR WRITTEN OR VERBAL UNDERSTANDINGS.
